Our Contract with You
Our Contract. These terms and conditions (Terms or T&C’s) apply to the
order by you (the Customer) and the supply of goods by us (the Supplier)
to you (Contract). No other terms are implied by trade, custom, practice or
course of dealing.
Entire Agreement. The Contract is the entire agreement between us in
relation to its subject matter. You acknowledge that you have not relied on
North East Shutters promise or representation or assurance or warranty that is
not set out in the Contract.
Language. These Terms and the Contract are made only in English
language. No translations of the Terms and Contract are provided.
How to Pay
Payment of Goods will be due: 50% on confirmation of order
50% immediately upon completion of fitting (the default method of
payment) By Bank Transfer
Our Warranty for the Goods
We provide a warranty that on delivery and for a period of 3 years from
point of order, the Goods shall be in accordance with our Warranty held
here.
In regards to the blinds provided the associated warranty for these
products will be for a period of one year from point of order. This warranty
will be in accordance with the separate warranty information provided.
Some of our products are made from a natural material, namely wood,
and as such there may be some minor imperfections which are not readily
apparent at a distance of four feet or under ordinary light and no such
imperfections shall be accepted as defects of the products. We reserve the
right to determine, at our sole discretion, whether a minor imperfection on
any of our products is to constitute a defect.
Subject to clause if:
You give us notice in writing within a reasonable time of discovery that
some or all of the goods do not comply with the warranty set out in clause
We are given a reasonable opportunity of examining the Goods; and
We ask you to do so, you return the Goods to us at your own expense.
We will, at our option, repair or replace the defective Goods, or refund the
price of the defective goods of 5% compensation.
We will not be liable for breach of the warranty set out in clause if:
You make any further use of the Goods after giving notice to us
The defect arises as a result of us following any drawing, design or
specification supplied by you;
You alter or repair the Goods
The defect arises as a result of fair wear and tear, wilful damage,
negligence, or abnormal storage or working conditions; or
The Goods differ from their description or specification as a result
of changes made to ensure they comply with applicable statutory or
regulatory requirements.
We will only be liable to you for the Goods’ failure to comply with the
warranty set out in the agreed Shutter fitting.

The terms implied by sections 13 to 15 of the Sale of Goods Act 1979 are,
to the fullest extent permitted by law, excluded from this contract.
The Terms also apply to any repaired or replacement Goods supplied
by us to you.
Third Party Rights
The Contract is between you and us. No other person has any rights to
enforce any of its terms, and the Contracts (Rights of Third Parties) Act
1999 does not apply to this Contract.
14.6 Governing Law and Jurisdiction
The Contract is governed by English law and each party irrevocably agrees
to submit all disputes arising out of or in connection with this Contract to
the exclusive jurisdiction of the English courts.
